The WIP Latam Industry Award aims to help complete a Latin American feature film from among those included in the WIP Latam selection at the San Sebastian Festival.
The Industry Award is open to 100% Latin American productions or co-productions, provided that third contries participation is no higher than 49% of the total film production and that they accept the conditions stipulated in point 4 of these rules.
Thus, the film winning the award will receive the different post-production detailed below and provided by the sponsoring companies: A Contracorriente Films, Deluxe Content Services Spain, Elamedia Estudios, Laserfilm Cine y Vídeo, Nephilim Producciones, Pecera Estudio.
Simply by presenting candidate projects to the WIP Latam Industry Award implies unlimited and unrestricted acceptance of these rules by the participating production companies.
A Jury consisting of representatives from each of the companies sponsoring this section (as mentioned above) will select the winning film after having viewed the works that require the services they offer and examining their situation.
The decisions taken by the Jury will be final.
The winning film will be announced at the San Sebastian Festival.
On behalf of the (aforementioned) sponsoring companies, NEPHILIM PRODUCCIONES, S.L. will sign a financial co-production contract with the winning production company in order that the winning film may obtain Spanish nationality for the purposes of improved commercialisation in Spain. This contract, whose text will be worded by NEPHILIM PRODUCCIONES, S.L., will be signed within a maximum of two months from the moment the Award is accepted by the winning production company. That is, the production company of the winning film must sign the contract with NEPHILIM PRODUCCIONES before December 1st of the current year, and in any case, before post-production works begin.
Under the said contract, NEPHILIM PRODUCCIONES, S.L. will become the audiovisual co-producer of the film and will therefore hold full rights to it. NEPHILIM PRODUCCIONES, S.L. will also obtain 100% of the exclusive film rights in Spain and non-exclusive film rights in Andorra.
Commercialisation of the film in Spain and Andorra will be decided and carried out by NEPHILIM PRODUCCIONES, S.L.
The winning production company shall guarantee that it owns the licensing rights to the film and that it is authorised to sign this co-production contract with NEPHILIM PRODUCCIONES, S.L. in the above terms. In the event that this guarantee fails to materialise, the production company will be held responsible for compensation to NEPHILIM PRODUCCIONES, S.L.
If the winning film is produced by a Spanish production company, NEPHILIM PRODUCCIONES, S.L. would obtain a percentage of the worldwide rights to the film, including Spain. This percentage shall be identical to the percentage represented by the contribution of the post-production companies in relation to the total cost of the film. Before signing the agreement, the awarded production company must communicate the total production cost incurred up to that moment, including all expenses except for post-production costs (which shall constitute the contribution of NEPHILIM PRODUCCIONES, S.L.) and publicity and print costs, which will be determined at a later stage.
The companies sponsoring the award shall carry out the post-production tasks that are their responsibility in accordance with the following description, no later than 31st July of the year after the one in which the award is presented. This work shall always be carried out following a work schedule that the companies themselves have designed and which the company producing the film must accept. The companies will contribute:
A CONTRACORRIENTE will guarantee release of the winning film in Spanish cinemas, with a minimum of 2 copies, and the corresponding advertising. The total advertising cost will be decided by A Contracorriente according to the film’s potential. A Contracorriente will decide the extent of the marketing campaign and the presence of the winning film at other national festivals. In addition, A Contracorriente can edit the title, the poster image and the trailer to suit the Spanish market, always with the producers’ approval.
DELUXE SPAIN is responsible for:
- Creating an EDL in high definition, completed and provided by the customer, up to a maximum of 40 hours.
- Graphic works (opening and closing title sequences), up to a maximum of 40 hours.
- Colour correction, up to 64 hours.
- Obtaining the DCP master (Digital Cinema Package), in original version with English subtitles.
- Master UHD-SDR.
ELAMEDIA ESTUDIOS will provide:
- VFX image work up to a maximum of 80 hours.
- Sound mixing during 10 mixing studio days or sessions.
Materials to be delivered:
- 5.1 mixing and LT RT to 24 FPS, by reels.
- 5.1 mixing and LT RT to 25 FPS, continuous.
LASERFILM will provide translation, adaptation and location of the English subtitles and Spanish (when needed) of the film, including a day of simulation with the native translator. It will also add the subtitles to the DCP.
They will also prepare the Spotting List.
NEPHILIM PRODUCCIONES S.L. will coordinate the post-production work and licensing of the film in Spain and Andorra as envisaged in these rules and in the co-production contract.
PECERA ESTUDIO will produce the sound design and editing (not including recording of the dubbing or foleys).
APPLICABLE CONDITIONS TO ANY POST-PRODUCTION WORK
Any additional work to those indicated by each company awarding the Prize, will be assumed by the awarded production company, and requested to the corresponding company.
The non-utilisation by the production company of any of the hours, work, disciplines or services that each company contributes to the Industry Award, as expressed in these terms and conditions, are not interchangeable with each other, or with other work or services not detailed in the terms and conditions.
